Initial Consultation
The process typically starts with an initial consultation with an attorney. During this meeting, the attorney will gather details about the accident, assess the potential claim's validity, and explain the legal process and the client's rights.
Negotiation and Settlement
The Road Accident Fund and the attorney will engage in negotiations to reach a fair settlement for the claim. The attorney's role is to advocate for their client's rights and ensure they receive adequate compensation for their injuries, medical expenses, loss of income, and other damages resulting from the accident.
Claim Submission
If the attorney believes there is a valid claim, they will proceed to submit the claim to the Road Accident Fund on behalf of the client. This involves gathering relevant documentation, such as medical reports, police reports, witness statements, and any other evidence supporting the claim.
Litigation
If the parties cannot reach a satisfactory settlement through negotiation, the attorney may advise their client to pursue litigation. This involves taking the matter to court, where a judge will make a determination on the compensation amount.
Assessment and Investigation
The Road Accident Fund will review the submitted claim and conduct its own investigation into the accident and the extent of the injuries or damages. This may involve obtaining additional medical assessments or other relevant information.
Claim Resolution
Once a settlement is reached, either through negotiation or litigation, the attorney will assist in finalizing the claim's resolution. This includes ensuring all necessary paperwork is completed, and the client receives the agreed-upon compensation.
Payment of Compensation
After the claim is resolved, the Road Accident Fund will pay the compensation amount to the client. The attorney will then receive their fees, which are typically based on a percentage of the compensation amount (contingency fee basis).
